1. Agreement to Terms
These Terms of Use (“Terms”) constitute a legally binding agreement between you and Monserrat Futbol (“we,” “us,” or “our”) governing your access to and use of our website, player portal, scheduling tools, payment services, and all related soccer training services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 18 years old to create an account and purchase services on behalf of yourself or a minor child. If you are under 18, a parent or legal guardian must create the account, provide consent, and accept these Terms on your behalf.
3. Services Description
Monserrat Futbol provides private and small-group soccer training sessions, development programs, trial evaluations, and related coaching services in Memphis, Tennessee, and surrounding areas. All sessions are conducted by or under the supervision of qualified coaching staff.
4. Account Registration
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your password and for all activity under your account.
5. Payments & Refunds
- All fees are due at the time of purchase unless otherwise agreed in writing.
- Session packages expire according to the validity period stated at purchase (e.g., 30 or 45 days).
- Refunds are granted on a case-by-case basis for unused sessions and must be requested in writing within 14 days of purchase. No refunds are provided for completed or expired sessions.
- We reserve the right to modify pricing at any time. Price changes do not affect already-purchased packages.
6. Scheduling, Cancellations & No-Shows
- Sessions must be scheduled through our online portal or by contacting us directly.
- Cancellations or rescheduling requests must be made at least 24 hours in advance. Late cancellations or no-shows may result in forfeiture of the session.
- We reserve the right to cancel or reschedule sessions due to weather, field availability, or coach illness. In such cases, your session credit will be preserved.
7. Assumption of Risk & Waiver
Soccer training involves inherent physical risks, including but not limited to muscle strains, sprains, fractures, concussions, and other injuries. By participating, you voluntarily assume all risks associated with training. You agree to release, indemnify, and hold harmless Monserrat Futbol, its coaches, agents, and affiliates from any claims, damages, or liabilities arising from participation, except for gross negligence or willful misconduct.
8. Conduct & Safety
Players, parents, and guardians are expected to behave respectfully toward coaches, staff, and other participants. We reserve the right to refuse service or terminate participation for disruptive, abusive, or unsafe behavior without refund.
9. Intellectual Property
All content on our website and portal—including text, images, videos, logos, and training materials—is owned by Monserrat Futbol or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Monserrat Futbol shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or related to your use of the Services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Tennessee, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Shelby County, Tennessee. You consent to the personal jurisdiction and venue of such courts.
12. Termination
We may suspend or terminate your access to the Services at any time, with or without cause and with or without notice, including for breach of these Terms. Upon termination, your right to use the Services immediately ceases, but all provisions that by their nature should survive termination shall survive.
13. Changes to These Terms
We may modify these Terms at any time by posting the revised version on our website. Material changes will be noted with an updated effective date. Your continued use of the Services after changes constitutes acceptance of the revised Terms.
